This Privacy Statement describes the Personal Information, as described below, that YardNexus Technologies (also referred to herein as “YardNexus”, “we”, “us”, “our”, or the like) collect from you in connection with your use of our “Services”, which are collectively considered as:
● Our websites, microsites, and mobile sites operated by us from which you are accessing this Privacy Statement;
● Our software applications made available for use on or through computers, mobile devices, and connected devices (to the extent not covered under a separate Privacy Statement);
● Our social media pages and apps that we control from which you are accessing this Privacy Statement;
● Our business and vendor relationships;
● Our products and services;
● Email messages or other communications with you that we send to you and link to this Privacy Statement;
● Offline interactions such as when you visit with us or attend a tradeshow; and
● Your interactions with us when you submit a request for customer support.

Personal Information We Collect
“Personal Information” is information that relates to an identified or identifiable individual, as such term is defined in the applicable law. We collect Personal Information through your use of our Services, automatically and in certain instances, from third parties. We also use and combine data to infer insights about you, for example, your product/service preferences, characteristics, predispositions, or behaviors. Our Service may contain links to other websites that are not operated by Us. If you click on a third-party link, you will be directed to that third party’s site, and we strongly advise you to review the Privacy Policy of every site you visit.
Depending on how you use our Services, we collect different types of Personal Information from you, including:
● Contact Information: includes your name, email address, phone number, address, and country of residence;
● Account Information: includes login credentials (related to your account);
● Device Information: includes technical information associated with the device you use, such as the device type and model, system language, browser type, geographical location, and operating system, and technical identifiers that identify the device you use, such as IP address, IDFA (identifier for advertisers), and other unique identifiers;
● User Content: includes information related to customer satisfaction surveys, customer requests or queries, and account information;
● Physical Location: includes your physical location including your precise geolocation that can be derived from your IP address, GPS coordinates, use of our connected products, your interactions with our emails, or your manually selected location, zip code or postal code, depending on the Service being provided;
● Relationship History: includes details of your contact with us, as well as order history; and
● Other Personal Information that you provide us.
We may also receive information about you from other sources, for example:
● Publicly available Personal Information, from publicly available databases, such as LinkedIn, product review websites, or local trade or industry associations’ registries, or following the monitoring of social media channels for feedback or following web data extraction;
● Data received from associated dealers or retailers of YardNexus products or our service providers; and
● Contact information, professional characteristics, and other information from data brokers, business partners, including for joint marketing and promotion events, and from event managers, influencers, and privately-owned marketing or survey/enquiry databases.
Information we generate or collect automatically through your use of our services or via our IT systems
● Log and usage data: We will log information when you access and use the Services. This may include information about the systems and device(s) you use to access our Services, including IP address, browser type and version, timezone setting, operating system and platform, device type, and device identifiers, as well as information to facilitate your use of our Services (including to provide access to third-party websites and services), such as URL requests, destination IP addresses, or device configuration details; and;
● Information collected from cookies and similar technologies: We use cookies, which are small text files that collect and track certain technical information, and similar technologies to help us operate and provide our Services to you. We use this information for various reasons including to improve the quality of our services, improve your experience, understand user activity, and personalize content and advertisements. Security
We may store your Personal Information in electronic format. We have implemented reasonable technical and organizational security measures to protect the Personal Information we collect from damage, misuse, interference, loss, alteration, destruction, unauthorized or accidental use, modification, disclosure, access or processing, and other unlawful forms of processing data. However, please be aware no data security measures can guarantee 100% security. While we monitor and maintain the security of the Services, we do not guarantee that the Services or any products or services are impervious to attack or that any use of the Services or any products or services will be uninterrupted or secure. In addition, information that you transmit over the Internet, including through e-mail or SMS message, is not secured by us and is inherently vulnerable to attack or interception.
Retention
We will retain your Personal Information for as long as needed for the purpose for which we are processing your data in accordance with applicable law, including for any legal, regulatory, tax, accounting or reporting requirements. Among the criteria used to determine retention periods include the nature and duration of our relationship with you and any business or legal requirements to retain your Personal Information, such as pursuant to litigation or regulatory investigations. Personal Information collected for recruitment purposes will be retained for a reasonable period of time in accordance with applicable laws, unless you are hired, in which case some of this information will be stored in your employment record.
Cookies and Tracking Mechanisms
We and our service providers use cookies, tracking pixels, and other tracking mechanisms to track information about your use of our Services and the applications and services available through our Services. You may disable certain tracking by disabling cookies in your web browser or by updating your consent preferences in the Cookie Consent Management Center as described in the Cookie Policy. Currently, oursystems do not recognize browser “Do Not Track” requests. Please see our Cookie Policy for additional information about our use of cookies, your ability to accept/decline cookies, and related information. Although we do not sell your Personal Information for money, we do disclose your Personal Information with some third-party partners for these advertising purposes, as disclosed in this Privacy Statement and in our Cookie Policy.
Additional information for consumers in the United States
CALIFORNIA CONSUMERS
If you are a California resident and the processing of Personal Information about you issubject to the California Consumer Privacy Act (“CCPA”)/California Privacy Rights Act (“CPRA”), California law grants certain rights as set forth below, subject to certain limitations:
● Right to know. You have a right to request that we disclose to you the Personal Information we have collected about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such Personal Information.
● Right to request deletion. You also have a right to request that we delete Personal Information under certain circumstances, subject to a number of exceptions.
● Right to Correction. You have the right to correct inaccuracies in your Personal Information.
● Right to Data Portability. You have the right to request that we provide you with your Personal Information in a portable format.
● Right to non-discrimination. The CCPA/CPRA prohibits discrimination against California residents for exercising their rights under the CCPA/CPRA, such as by denying or providing a different level or quality of goods or services, or charging different prices or imposing penalties on residents who exercise their CCPA/CPRA rights, unless doing so is reasonably related to the value providedto the business by the residents’ data.
● The Right to Opt Out. You have the right to opt out of the sharing of your Personal Information for cross-context behavioral advertising purposes and the sale of your Personal Information. Although we do not sell your Personal Information for money, we do disclose your Personal Information with somethird-party partners for these advertising purposes, as disclosed in this Privacy Statement and in our Cookie Policy. Please be prepared to provide your first and last name and email address that matchesinformation we currently have on file. Where we are unable to verify your identity based upon this information alone, we may require additional details. You may designate, inwriting or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA/CPRA. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act onyour behalf, and we may need you to verify your identity directly with us. We will respond to verifiable requests received from California consumers as required by law.
Under California’s Shine the Light law, California residents who provide us certainPersonal Information are entitled to request and obtain from us, free of charge,information about the Personal Information (if any, and as defined under the law) thatwe have shared with third parties during the preceding calendar year for their own directmarketing purposes. We do not share your Personal Information in this way.
COLORADO, CONNECTICUT, FLORIDA, MONTANA, OREGON, TEXAS, UTAH, ANDVIRGINIA CONSUMERS
If you are a Colorado, Connecticut, Florida, Montana, Oregon, Texas, Utah, or Virginia resident and the processing of Personal Information about you is subject to these statelaws, subject to certain limitations, you have the following rights:
● Right of Access. You have the right to confirm whether we process your PersonalInformation and request to access to such Personal Information.
● Right to Deletion. You have the right to request that we delete PersonalInformation we have collected about you.
● Right to Data Portability. You have the right to request that we provide you withyour Personal Information in a portable format.
● The Right to Opt-Out. You have the right to opt out of targeted advertising andthe sale of your Personal Information. At this time, we do not process yourPersonal Information for purposes of profiling in furtherance of decisions thatproduce legally or similarly significant effects concerning a consumer, andtherefore, such opt-out rights are not available.

Please be prepared to provide your first and last name and email address that matches information we currently have on file. Where we are unableto verify your identity based upon this information alone, we may require additional details. We will respond to verifiable requests received from consumers who areresidents of the above-named states as required by law. If we are unable to verify youridentity, we may deny your request and we may provide you with a notice explaining ourdecision to deny your request.
Authorized Agents in Colorado, Connecticut, Florida, Montana, Oregon, Texas, and Utah:
If you want to make a request as an authorized agent on behalf of a Colorado, Connecticut, Florida, Montana, Oregon, Texas, or Utah resident, you may use the submission methods noted above. As part of our verification process, we may requestthat you provide, as applicable, proof concerning your status as an authorized agent. Inaddition, we may require the individual on whose behalf you are making the request toverify their own identity or your permission to submit the request.
APPEALS
If we deny your request to exercise any of the above-listed rights, we will inform you,within the time permitted by law, of the reasons for not taking action on your request. You may have the right to appeal a denial of your request to exercise any of the above-listed rights. You may do so by following the appeal instructions outlined in therelevant communication we send to you.
We will provide a decision on your appeal within a reasonable time as permitted by law. If an appeal is denied, or in some instances if you have concerns about the results of anappeal, we will provide you with information about how you may contact the relevantstate authority to submit a complaint.
Withdrawal of Your Consent
If you have given us your consent to process your Personal Information for a specific purpose, this consent is the legal basis for the processing of your Personal Information. You can withdraw the consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until you withdraw it. You can declare the withdrawal using the address listed under section “Contact us” below.
Children/Minors
Our Service is not intended for anyone under the age of 13. As such, we do not knowingly collect personally identifiable information from anyone under the age of 13; however, if we become aware that we have collected Personal Information from anyone under the age of 13, we will take appropriate measures to remove that information from our systems.
Changes to This Privacy Statement
We may amend or update this policy from time to time and will notify you of any material changes to this policy. Previous versions of this privacy policy are available upon request.
